JULY 2012 IBERO-AMERICAN BAR RESOLUTION

regarding U.S. Non-Consensual Human Medical Experimentation in Guatemala

ANTIGUA, GUATEMALA DECLARATION

Gathered, in Antigua, Guatemala, July 12-14, 2012, for the III Meeting of the Presidents of the Ibero-American Bar Associations, the following representatives of those legal associations:  Dr. Henry Saint Dahl, of the Inter-American Legal Affairs Committee of the Washington, DC Bar Association; Attorney Rosa Guerrero Zárate, Member of the Executive Counsel of the Confederation of Schools and Bar Association of Mexico; Attorney Lidia Herrera, Board of Directors of the Guatemalan Bar Association; Attorney Claudia Patricia Abril, Board of Directors of the Guatemalan Bar Association; Attorney Visente Hernández, of the Confederation of Schools and Bar Association of Mexico; Attorney Fanuel García, Board of Directors of the Guatemalan Bar Association; and Dr. José Guillermo Alfredo Cabrera, [President] of the Guatemalan Bar Association

In light of:

The highest values and principles that accompany the practice of the legal profession and its impact on the Rule of Law.

Having participated as full members and as witnesses of honor, respectively, in the formulation of recommendations of the III Meeting, agreed to sign the present declaration to state their opinion on the following point in particular:

The non-consensual experiments that were begun on Guatemalan Citizens in the 1940s constitute a grave violation of Human Rights. This fact has been publicly recognized by the Government of the United States of America. In light of this, and without reaching legal technicalities such as sovereign immunity, we call upon the United States of America to indemnify the victims of such experiments in furtherance of justice and equality.
